Weagle to sue Trek over 'concentric pivot patent breach'

Trek's Active Braking Pivot alleged to be in breach of Split Pivot Inc patent

Split Pivot Inc, Dave Weagle's suspension design firm, is to take Trek to court over an alleged infringement of a concentric pivot patent registered by the design expert.

Trek's Active Braking pivot has been on the market for four years now, though Weagle claims it is based around a then patent pending design he had shown the firm back in 2007. Just one month later it is believed Trek submitted and secured a similar patent.

The infringement is related to two of Weagle's patents registered in 2010 and 2011, based around the ability to isolate braking forces from the rear shock.

Trek are believed to be ready to fight Weagle's claim in the Madison, Wisconsin Court, where Weagle is seeking a jury-based trial and is seeking licensing fees.
