128 per cent increase in cyclists claiming damages, says Solicitors

Spencers Solicitors says that with transport choices shifting claims from cyclists against motorists are rising sharply

Claims from cyclists against motorists have more than doubled, according to personal injury specialists Spencers Solicitors.

Since 2011, the firm has received 128 per cent more claims against motorists alleged to have been at fault for incidents on the road.

Among the most recent settled cases, compensation awards have varied from £1,000 to £20,000, depending on the circumstances.

"Most accidents that we have come across are on roundabouts or when the ‘at fault driver’ is turning into or out of a side road. Therefore, it’s safe to assume that the observations of motor vehicle drivers is a primary cause of the accidents and the cyclist rarely feature as contributing to the incident," said a spokesperson for Spencers.

A break down of the stats:

Figures from RoSPA in October of last year showed 80 per cent of accidents took place in the daytime, with 3 – 6pm and 8 – 9am on weekdays the most dangerous times for cyclists.

Head injuries, ranging from fatal skill fractures and brain damage to minor concussion and cuts accounted for over 40 per cent of cyclist injuries in hospital data. A study of 116 fatal cyclist accidents in London and rural areas found over 70 per cent in London had moderate or serious head injuries.

The most common factor in accidents involving a bicycle and vehicle, recorded by police is ‘failure to look properly’ - with the motorist deemed to be to blame in 57 per cent of reported cases.

In other news, a solicitor recently said that the 'floodgates are open' for cyclists injured in collisions with potholes, following a decision to award cyclist Alan Curtis £70,000 in damages.
