Court rules that Mavic’s IP rights were violated by auction site

On the 2nd of September 2015 the District Court in Sucha Beskidzka, south of Poland, gave a favorable decision in a criminal case initiated by Mavic SAS in France regarding infringement of its community trademarks “Mavic” and “Cosmic”.

The accused individuals manufactured wheels and marked them with “Mavic” and “Cosmic” trademarks. The infringing wheels were then sold to Polish consumers online via the auction sales portal www.allegro.pl.

The District Court has found individuals guilty of violating Mavic’s industrial property rights and sentenced the individuals to pay fines and damages to Mavic SAS. In addition, the District Court also ordered seizure and destruction of the wheels infringing Mavic SAS’s rights.
