Europe's second biggest bike group to sue Dutch-equivalent of UK's OFT

Last November the Netherlands Competition Authority (NMa), the equivalent of the UK's Office of Fair Trading, accused the Accell Group of entering into price-fixing agreements. At the time, the Accell Group asked the NMa to put up or shut up. The NMa failed to respond so the owner of brands such as Batavus, Koga Miyata and Sparta has issued a writ of summons against Nederlandse Mededingingsautoriteit

The publically-listed Accell Group claims the NMa's press release was issued without Accell "being given any opportunity to rebut the allegations."

Rene Takens, CEO of Accell and president of COLIBI, said "[we are] of the opinion that the allegations are unfounded and that the press release contains factual inaccuracies. The NMa sent the investigation report to parties who were not involved in the investigation. This has meant that competitive information has been spread within the bicycle sector."

Accell Group claims the NMa acted unlawfully and is claiming damages. The action will be brought in the Court of The Hague on 21st May.
